These Terms of Service ("Terms") govern your use of the EG Fusion platform and services provided by EG Fusion ("we," "our," or "us") at egfusion.com. By accessing or using EG Fusion, you agree to be bound by these Terms. If you do not agree, do not use our services.

1. Description of Service

EG Fusion is an AI-powered intake automation platform designed for plaintiff-side personal injury law firms. The platform receives intake form submissions, qualifies leads using artificial intelligence, and routes qualified leads to the firm's designated CRM system. EG Fusion also sends automated email and SMS notifications to law firm intake coordinators when qualified leads are received.

2. SMS Messaging Terms

EG Fusion operates an SMS notification program under the following terms:

• Program name: EG Fusion Lead Notifications
• Program description: Automated SMS alerts sent to law firm intake coordinators when new qualified leads are submitted through the firm's intake form. Messages include lead quality score, case type, and recommended next action.
• Message frequency: Message frequency varies based on lead volume. Multiple messages per day may be sent during high-volume periods.
• Message and data rates: Message and data rates may apply. Check with your mobile carrier for details.
• Opt-out: Reply STOP at any time to unsubscribe. You will receive one confirmation message and no further messages will be sent.
• Help: Reply HELP for assistance, or contact us at hello@egfusion.com.
• Supported carriers: AT&T, T-Mobile, Verizon, and most major US carriers. Carrier support not guaranteed.

We do not share your phone number or messaging data with third parties for marketing purposes.

3. Eligibility and Accounts

EG Fusion services are intended for use by law firms and their authorized representatives. By using our platform, you represent that:

• You are at least 18 years of age.
• You are authorized to enter into these Terms on behalf of your organization.
• You will use EG Fusion only for lawful purposes in accordance with these Terms.

4. Acceptable Use

You agree not to:

• Use EG Fusion for any unlawful, fraudulent, or deceptive purpose.
• Attempt to gain unauthorized access to any part of the platform or its infrastructure.
• Reverse engineer, decompile, or disassemble any portion of the platform.
• Use the platform to send unsolicited messages or spam.
• Interfere with the proper functioning of the platform or its services.

5. CRM Integration and Data

EG Fusion integrates with third-party CRM systems (such as Filevine and Clio) on behalf of law firm clients. You are responsible for ensuring that your use of these integrations complies with your agreements with those CRM providers. EG Fusion is not responsible for data loss, errors, or service interruptions caused by third-party CRM systems.

6. Intellectual Property

All content, features, and functionality of the EG Fusion platform — including software, design, text, graphics, and logos — are the exclusive property of EG Fusion and are protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any part of the platform without our prior written consent.

7. Disclaimers

EG Fusion is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:

• The platform will be uninterrupted, error-free, or secure at all times.
• AI-generated lead qualifications will be accurate in every instance.
• CRM integrations will function without errors or data loss.

EG Fusion does not provide legal advice. Lead qualification outputs are automated assessments intended to assist law firm intake processes and do not constitute legal opinions.

8. Limitation of Liability

To the fullest extent permitted by law, EG Fusion shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use our platform, even if we have been advised of the possibility of such damages. Our total liability to you for any claims arising under these Terms shall not exceed the amount paid by you to EG Fusion in the three months preceding the claim.

9. Termination

We reserve the right to suspend or terminate access to EG Fusion at our discretion, with or without notice, for conduct that violates these Terms or is otherwise harmful to EG Fusion, its clients, or third parties. Upon termination, your right to use the platform will immediately cease.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Ventura County, California.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Continued use of EG Fusion after changes are posted constitutes your acceptance of the updated Terms.
